My father and mother retired to Boca Raton, Florida in the early 1980's. After declaring Florida as their legal residence, they drafted Florida wills and trusts. These documents were prepared in April, 1984, by Attorney Don Sider of Boca Raton. In 1989 my father had a stroke, this was the first of many health problems. He died in Manor Care Nursing Home in October, 1995.
After he was without mental capacity to understand what was happening with his assets, another Boca Raton attorney, R. Brady Osborne, entered dad's nursing home room without the knowledge or consent of the family, and had him "sign" a new will and trust that changed the terms originally drafted by my parents.
This new will removed the family members as sucessor trustees, and named Nations Bank in their place.
Nations Bank is now Bank of America, one of the banks involved with the Endron problems.
The accounting firm used was Arthur Andersen & Company, also involved with Endron!
The trusts were passed to First Security Trust Company in 1996.
Mother died in the same nursing home in September, 2000.
The trusts involved were passed to Coconut Grove Bank after First Security Trust asked the 15th District Florida Court to allow them to withdraw as "personal representative", stating in their court papers that the "assets" of the Donald Perkins estate were distributed!
to this date (June 25,2003), the assets from both the Donald C. Perkins and the Elsie M. Perkins trusts have not been settled.
Stocks, Real Estate, Personal Property, and various other valuables are either still in Coconut Grove Bank, or spent by them!
The attorneys have received over $100,000.00 dollars and are still charging more to keep the settlement from happening.
I have read some of the other "horror stories" that are out there on the web.
Can someone help me end this unbelievable nightmare that I am living.
