I am a beneficiary of an inheritance from my mother, Lise Proulx. Being on a disability called the Ontario Disability Support Payment Plan, it does not allow the receipient to collect an inheritance, which would immediately disqualify me from the 'system'. In 1989, a new provision was made called The Henson Trust, only acceptable in Ontario, for beneficiaries on disability, where a trustee(s) would administer the fund in the way that they felt suitable. Unfortunately my mother being so ill, left the duty to my sister and executor lawyer, without the clause of 'removal' or any flexibility for the beneficiary, which is myself. I have had to hire another lawyer, who has brought this to court, ending with a temporary dismissal from the trustee's new lawyer. Since then, the trustee(s) have left the balance of the trust with a finance company, and no one is managing the trust. This trust finances my lawyer, who is presently doing nothing to resolve my case. I have no extra income coming in, and bills are piling up. I have sought legal aid, and they say that I do have a case against the executor lawyer, but would have to hire yet another lawyer to bring him to court, as my own lawyer has a difference of opinion on the subject. I am presently submitting my case of neglect and delay to the Upper Canada Law Society seeking advice and or action to be taken on behalf of this situation. I am also hoping to put an article in the city's newspaper to expose the inneficient way that this Trust is being handled, and misused. If there are any other Ontarians, or other people in this kind of situation, I would appreciate some feedback. Thanks for listening to my story.
