I am not sure if I am a victim yet. My Dad passed in 1994. He had no will. His estate is worth 1.3 million. The file # in court is S-1-95. My sister and I allow my brother to administrate his estate. We sign an agreement to divide estate 3 ways. My brother to this date has not closed my fathers estate. He has done some criminal acts mainly having signed a check made out to me. I have that evidence. I have been through 2 lawyers. The 2nd one let the statute of limitations run out on the fraud. My present attorney is on the ball and I am pressing the matter in surrogate's. Their are alot of details left out. My question is "Why does the court not take independent action against my brother? I believe that if I did not request an accounting the court would do nothing. I can't wait to see this accounting. If my brother pissed the money away what can the court do for me? I am very disappointed in the way this system operates. I should say angry. Anyone have a comment or suggestions.
